  1. Representation & Brand Authority

By submitting this application and accepting this Candidate Data Consent, you appoint MetalExpert UAB (hereinafter “the Agency“) to act as your representative for professional recruitment and placement services. You acknowledge that MetalXpat is a brand name and web domain owned and operated by MetalExpert UAB.

  1. No Employer-Employee Relationship

You explicitly acknowledge that by accepting to this Candidate Data Consent agreement, MetalExpert UAB is a recruitment and placement agency, not an employer. At no stage of the application, representation, or visa facilitation process shall an employer-employee relationship be created between the Candidate and MetalExpert UAB. Any future employment relationship will be solely between the Candidate and the third-party Hiring Employer.

  1. Non-Exclusive Representation & No Guarantee
  • Non-Exclusivity: This representation is non-exclusive. You remain free to seek employment through other channels.
  • No Obligation: You accept the opportunity to receive job offers curated by the Agency but are under no obligation to accept any offer presented.
  • No Guarantee of Placement: The Agency provides “best effort” recruitment services. Submission of an application does not guarantee an interview, a job offer, or the successful issuance of a work visa.
  1. Consent for Data Processing & Extended Sharing

In accordance with GDPR, you authorize the Agency to:

  • Store and analyze your profile, including salary and remuneration data, for matching and negotiation.
  • Share your CV, PII, and certifications with prospective Employers, Employer Organizations, and Chambers of Commerce.
  • Disclose relevant data to EU Government Agencies and Ministries of Labor for the purpose of immigration pre-approval, labor market testing, and work permit facilitation.
  • Receive feedback and contract terms from employers regarding your application.
  1. Candidate Warranty & Verification

By accepting this Candidate Data Consent, You warrant that all information, diplomas, and professional certifications provided are authentic. The Agency reserves the right to perform background checks. You acknowledge that any costs associated with the notarization or apostille of your personal documents are your sole responsibility unless otherwise agreed in writing.

  1. Immigration, Visa Facilitation & Limitation of Liability

You authorize the Agency to submit your PII and identification documents to Immigration Authorities and Embassies.

  • Final Decision Authority: You acknowledge that the final decision regarding employment rests solely with the Employer, and the final decision regarding visa issuance rests solely with the In-Country Immigration Authorities.
  • Disclaimer of Liability: MetalExpert UAB shall not be held responsible for any negative decisions, including job offer withdrawals or visa denials.
  • Waiver of Claims: By accepting these terms, you agree that you will not initiate any legal arguments, claims, or proceedings against MetalExpert UAB in the event of a rejected employment or visa application.
  1. Data Security & Liability Shield

While the Agency employs industry-standard security, you acknowledge that no electronic storage is 100% secure. MetalExpert UAB and MetalXpat shall not be held liable for damages arising from data leaks or unauthorized access to PII that occur despite our security protocols or due to third-party actions.

  1. Communication & Electronic Signature

You agree by accepting this Candidate Data Consent that all formal communication via email or verified messaging platforms (e.g., WhatsApp) shall be considered “in writing.” Clicking “I Accept,” “Submit,” or “Apply” on our digital platforms constitutes a legally binding electronic signature under EU Regulation No 910/2014 (eIDAS).

  1. Accuracy, Retention & Deletion
  • Accuracy: Misrepresentation may lead to immediate termination of representation and reporting to authorities.
  • Retention: Data is retained for 3 years from your last interaction.
  • Right to Erasure: You may request the immediate deletion of your data at any time by emailing info@metalexpat.com.
  1. Explicit Opt-In for Ongoing Communication & Marketing

By accepting these terms, you provide your explicit opt-in consent to receive communications from the Agency via email, SMS, or messaging apps regarding:

  • Job Offers: Direct notifications of suitable employment placements.
  • Company News & Activities: Updates regarding MetalXpat services, new recruitment programs, and industry insights.
  • Administrative Updates: Information regarding your application status or changes to our Candidate Data Consent.
  • Right to Withdraw: This opt-in is voluntary. You may withdraw your consent to this Candidate Data Consent as well as for for marketing and non-essential news at any time by using the “Unsubscribe” link in our emails or contacting us directly at info@metalexpat.com.
  1. Governing Law & Jurisdiction

These Candidate Data Consent and any dispute arising from it shall be governed by and construed in accordance with the laws of the Republic of Lithuania. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts in Vilnius, Lithuania.
